MAMAVATION CONTENT ACCESS AGREEMENT
PURPOSE OF THIS AGREEMENT
This Content Access Agreement explains the terms that apply when you request access to certain research results, test data, rankings, analyses, and related proprietary content published by Mamavation on restricted areas of the Mamavation.com website (the “Gated Content”). This Gated Content reflects significant financial investment, testing, research methodology, and editorial expertise, and forms part of the core value that Mamavation provides to its audience and community.
The purpose of this Agreement is to grant you limited and conditional permission to view the Gated Content for your personal use while strictly defining how that content may be handled. Access is provided on the clear understanding that the Gated Content must not be copied, exported, saved, recorded, screenshotted, summarized, paraphrased, transformed, republished, referenced publicly, or used to create competing materials, reports, or publications in any form, whether commercial or non-commercial, without prior written approval from Mamavation.
By choosing to access the Gated Content, you acknowledge that this permission is narrow, revocable, and subject to full compliance with the terms of this Agreement. If you do not agree to these terms, you should not attempt to view or engage with the Gated Content. This Agreement establishes the basis on which access is granted, the limits of your use, and the actions Mamavation may take if these terms are violated.
DEFINITIONS
For the purposes of this Agreement:
“Mamavation” refers to the Mamavation.com website, its operators, content owners, and authorized representatives.
“Content” or “Gated Content” means the research results, laboratory testing data, rankings, reports, analyses, written findings, charts, graphics, comparisons, and any related information or material that is not publicly accessible on Mamavation.com unless a user agrees to this Agreement and completes the access process. This includes the substance of the information itself, whether displayed on the page, downloadable, visual, tabular, or presented in narrative form.
“Access” means the temporary, conditional, revocable ability to view the Content through the Mamavation.com website after completing the required opt-in steps.
“Use” means any form of handling, copying, saving, recording, storing, reproducing, summarizing, sharing, reposting, republishing, distribution, or any action that extracts or relies on the Content in whole or in part, whether digital, printed, automated, verbal, or paraphrased. Use also covers actions taken manually or through software, bots, scraping tools, AI training models, or automated scripts.
“You” or “User” means any person who requests, attempts to access, or gains access to the Content, whether on their own behalf or for another person, organization, publication, platform, agency, brand, research group, or commercial entity.
GRANT OF ACCESS — NO OWNERSHIP OR LICENSE
By accessing the restricted content on Mamavation.com, you are being given a limited and revocable right to view the Content for your own personal and non-commercial use. This access is conditional and does not mean you have purchased, been assigned, or been granted any ownership, license, or broader rights to the Content. Your permission ends at viewing the Content for yourself under the terms of this Agreement.
All intellectual property and proprietary rights in the Content belong solely to Mamavation. Nothing in this Agreement permits you to copy, save, record, publish, distribute, summarize, paraphrase, create derivative works, train AI models, or reuse the Content in any form. Access does not allow you to share the substance of the Content—whether quoted, rewritten, reorganized, or presented as your own thoughts, analysis, or reporting.
Mamavation may change, limit, or withdraw your access at any time, and access does not create a guarantee of continued availability now or in the future.
IDENTITY AND EMAIL VERIFICATION
Access to the restricted content is tied to a real, verifiable identity. You agree to provide accurate information when requesting access, including a valid email address that belongs to you. We may require verification of your email or identity before access is granted or continued.
You may not create multiple accounts, false identities, or use temporary, disposable, or misleading email addresses for the purpose of accessing the content. Access obtained through false information, shared credentials, or attempts to mask identity will be considered a breach of this Agreement. Mamavation reserves the right to deny, suspend, or cancel access if there is any indication that the identity provided is inaccurate, unverifiable, or associated with misuse.
RESTRICTIONS AND PROHIBITED USES
Access to the content on Mamavation.com allows you to view the information for your personal, non-commercial use only. You agree that you will not, directly or indirectly, copy, save, download, record, screenshot, photograph, or otherwise capture the content in any format.
You may not republish, repost, upload, broadcast, submit to another website, platform, or media outlet, or make the content available to any third party. This includes text, data, results, rankings, tables, graphics, conclusions, and any interpretation or summary of them.
You are prohibited from rewriting, restructuring, reframing, paraphrasing, or altering the content in a way that presents it as new, original, or your own analysis, whether in written, visual, audio, or video form. This includes using the information to create articles, social posts, research summaries, buyer guides, reviews, comparison charts, podcasts, presentations, newsletters, or reports.
You may not use the content as input or reference for training or improving artificial intelligence models, machine learning tools, or data-collection systems, nor may you extract, harvest, scrape, or index the information using automated tools, bots, scripts, or scraping technology.
You may not incorporate the content into any product or service, paid or unpaid, and you may not use it to advise, consult, publish, or influence the decision-making of others on matters related to the content.
Any attempt to bypass paywalls, remove watermarks, alter access paths, share credentials, or otherwise circumvent access controls is prohibited.
CONFIDENTIALITY
The content you access through Mamavation.com is provided to you on a confidential and private-access basis. You agree that the content, and the substance of the information it contains, is not intended for distribution and may not be shared with any other person or entity. This includes employers, coworkers, contractors, independent consultants, virtual assistants, marketers, agencies, students, research groups, publishers, clients, family members, or any other third party—even if such individuals or entities are subject to a nondisclosure agreement of their own.
Confidentiality applies to the material itself and to any insight, result, ranking, comparison, or interpretation based on the content. Sharing the substance of the information—whether quoted, summarized, paraphrased, depicted visually, used in presentations, or re-explained in your own words—will be treated as a disclosure under this Agreement.
Your obligation to maintain confidentiality continues indefinitely and does not end when your access expires, is suspended, or is revoked. Attempts to disclose the content, facilitate access for others, or allow another person to benefit from the content through you, are considered a breach of this Agreement.
NO EDUCATIONAL, RESEARCH, OR “FAIR USE” EXCEPTIONS
Access to the content does not grant you any rights under copyright “fair use,” “educational use,” “research use,” or similar exceptions. The content is not permitted to be used for teaching, academic work, research projects, industry reporting, policy development, media coverage, commentary, or publication without express written permission from Mamavation.
You may not cite, quote, reference, or rely on the content as a source in academic work, journalistic materials, presentations, industry briefs, white papers, market reports, or articles. The fact that the content may relate to issues of public interest does not remove these restrictions or create rights to reuse it.
The limitations in this Agreement apply regardless of whether the intended use is commercial, non-commercial, educational, or informational. Requests for permission must be made directly to Mamavation and approved in writing before any reuse or public reference takes place.
REVOCATION AND SUSPENSION OF ACCESS
Mamavation may limit, suspend, or revoke your ability to access the content at any time, with or without notice, if there is reason to believe you have violated this Agreement or if your access is no longer appropriate for any reason determined by Mamavation in its sole discretion.
Revocation of access does not cancel or reduce your obligations under this Agreement. Any rights you may have had to view the content end immediately upon revocation, and you must stop using the content and delete any copies, notes, summaries, or materials derived from it, whether stored digitally, written manually, or otherwise preserved.
Mamavation may restrict future access to you or to any accounts, email addresses, or identities associated with your prior use. Attempts to regain access after revocation—whether directly, indirectly, or through another person—constitute a breach of this Agreement.
CONSEQUENCES AND REMEDIES
If you violate this Agreement or misuse the content in any way, Mamavation may pursue any remedy available under law or equity. This may include demanding the removal of any copied, republished, summarized, paraphrased, or derivative material; seeking financial damages; and requesting court orders to stop further use or distribution.
You acknowledge that unauthorized use or disclosure of the content may cause harm that cannot be adequately addressed through monetary compensation alone. Mamavation is entitled to seek injunctive relief—meaning a court order requiring you to stop the prohibited activity—without the need to prove actual financial loss.
Mamavation may also recover costs and expenses associated with enforcement, including investigation costs, legal fees, and any administrative expenses necessary to address or respond to the misuse.
These consequences apply even if access has already been revoked, expired, or was never properly acquired. Misuse of the content after access ends is treated the same as misuse during access.
NO CIRCUMVENTION OF ACCESS CONTROLS
You may not attempt to bypass, avoid, remove, deactivate, or otherwise interfere with any access restrictions or technological protections used by Mamavation to control availability of the content. This includes, but is not limited to, paywalls, registration requirements, email verification, login credentials, timed access, watermarks, view limitations, or other access-management tools.
You may not use scraping tools, automated bots, screen-capture utilities, browser extensions, inspection tools, or other software or technical methods to access, record, copy, extract, or store the content. You may not allow another person to access the content through your account, nor may you share access credentials, verification links, or login details with others.
Any attempt to obtain access through false identities, multiple accounts, misleading contact information, or third-party intermediaries is a violation of this Agreement. Efforts to circumvent access controls are treated as unauthorized access and misuse of the content.
RELATIONSHIP WITH MAIN TERMS OF SERVICE
This Agreement supplements the Mamavation Website Terms of Service. By requesting and obtaining access to the restricted content, you agree that both this Agreement and the Terms of Service apply to your use of the Mamavation.com website.
If any part of this Agreement conflicts with the Terms of Service, this Agreement will govern and control your access to and use of the restricted content. All other provisions of the Terms of Service remain in full effect and continue to apply to your general use of the website.
Your acceptance of this Agreement does not limit Mamavation’s rights under its Terms of Service, Privacy Policy, or any other posted policy.
ACCEPTANCE — WHEN CONSENT OCCURS
You agree to the terms of this Agreement when you complete any action that indicates your intention to access the restricted content. This includes checking an “I Agree” box, clicking a button to continue, submitting your email to unlock content, verifying your email address, or any step that grants you access to the content.
Your acceptance is effective at the moment you take the action that results in access, whether or not you have read the Agreement in full. If you do not agree to these terms, you must not complete the access process or view the content.
Accessing the content on behalf of another person or entity constitutes acceptance of this Agreement both for yourself and for that other person or entity.
ELECTRONIC SIGNATURE AND CONSENT
Your agreement to these terms is considered an electronic signature under applicable electronic signature and e-contract laws. By completing any step in the access process—such as checking a box, clicking to continue, submitting your email, or verifying access—you acknowledge that your action serves as your legally binding signature to this Agreement.
No physical signature, in-person meeting, or paper document is required for this Agreement to be valid and enforceable. You consent to conduct this transaction electronically and acknowledge that all notices, disclosures, and records related to this Agreement may be provided in electronic form.
RECORDKEEPING AND PROOF OF CONSENT
Mamavation may store information related to your access and agreement to these terms, including the date and time of acceptance, the version of this Agreement presented to you, your IP address, device or browser details, and the email address or identity used to register. These records may be used to verify consent, enforce this Agreement, or respond to legal, compliance, or security matters.
You consent to the creation, retention, and use of these records for the purposes described above. Mamavation may retain these records for as long as needed to protect its interests, enforce this Agreement, or comply with legal or regulatory requirements.
CHANGES TO THIS AGREEMENT
Mamavation may update or modify this Agreement from time to time. If the changes are material, Mamavation will take reasonable steps to notify users who currently have active access or who request future access. Updated versions of this Agreement will apply to all access requested or granted after the effective date of the updated version.
Continued access to or use of the restricted content after an updated Agreement is presented constitutes acceptance of the updated terms. If you do not agree to the updated terms, you must stop accessing the content and discontinue any use of it.
HOW TO REQUEST PERMISSION TO REFERENCE, CITE, OR REUSE
If you wish to reference, cite, quote, summarize, publish, or otherwise reuse any portion of the content, including derivative insights or conclusions based on the content, you must request permission in writing before doing so. Requests should clearly describe the material you hope to use, the purpose of the use, and where the material will appear.
Submitting a request does not guarantee approval. Mamavation may grant or deny permission in its sole discretion and may impose conditions or require written acknowledgement, paid licensing, attribution requirements, or other terms as a condition of approval. Permission must be granted in writing to be valid. No verbal statements, informal discussions, or assumptions constitute authorization.
GOVERNING LAW AND JURISDICTION
This Agreement, and any dispute or claim arising out of or related to it, including any non-contractual dispute or claim, shall be governed by and interpreted in accordance with the internal laws of the State of California, without regard to any choice or conflict of law provision or rule that would apply the laws of any other state or jurisdiction.
You agree that any legal action, claim, or proceeding arising out of or relating to this Agreement or your access to the content shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction and venue of those courts. You waive any objection to such jurisdiction and venue, including objections based on inconvenience.
DISCLAIMER OF ACCURACY / NO WARRANTY
The content made available through Mamavation.com is provided “as is” and “as available.” While Mamavation invests significant effort and resources into research, testing, and analysis, Mamavation makes no representations or warranties regarding the accuracy, completeness, reliability, or currentness of the content. The content may include data or findings that rely on third-party laboratories, sources, suppliers, or processes that are outside of Mamavation’s control.
Mamavation does not guarantee that the content is free from errors, omissions, or changes in underlying data. The content may be updated, corrected, expanded, or removed at any time. Your reliance on the content is at your own discretion and risk.
To the fullest extent permitted by law, Mamavation disclaims all warranties, express or implied, including any warranty of accuracy, non-infringement, merchantability, or fitness for a particular purpose.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mamavation shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or statutory damages arising out of or relating to your access to or use of the content, including any decisions you make or actions you take based on the content. This limitation applies even if Mamavation has been advised of the possibility of such damages.
Mamavation is not responsible for any claims, losses, or damages resulting from reliance on the content, including decisions about product use, purchasing, medical or health considerations, lifestyle changes, or any other actions influenced by the material.
If liability cannot be excluded and must be limited under applicable law, Mamavation’s total liability shall not exceed the amount you paid, if any, to obtain access to the content.
NO PROFESSIONAL ADVICE
The content made available through Mamavation.com is presented for general informational purposes only and should not be considered medical, legal, scientific, or professional advice. Mamavation does not provide medical or health treatment, diagnose conditions, offer product guarantees, or advise on legal rights or obligations.
You should not rely on the content as a substitute for professional advice. Decisions involving health, safety, product selection, legal obligations, or financial impact should be made in consultation with qualified professionals who can evaluate your specific circumstances.
Your access to the content does not create any professional-client relationship between you and Mamavation or its representatives.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Mamavation regarding access to and use of the restricted content on Mamavation.com. It replaces and supersedes any prior or contemporaneous understandings, agreements, discussions, or representations, whether written or verbal, relating to the same subject matter.
No statement, communication, or content on the Mamavation website, in emails, social platforms, marketing materials, or in conversations with Mamavation representatives alters or expands the terms of this Agreement unless expressly stated in a written amendment signed by Mamavation.
SEVERABILITY
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect. The invalidity of one part of this Agreement does not affect the validity or enforceability of the rest.
NO WAIVER
If Mamavation does not enforce any right or provision of this Agreement, that does not constitute a waiver of the right to enforce it later. A waiver is only effective if it is provided in writing and signed by Mamavation. Failure to enforce any part of this Agreement does not waive Mamavation’s right to enforce the same or any other provision in the future.
